Another victim of saenz21

I just wanted to post about a bad business transaction I had with saenz21.

I just joined the board and have really enjoyed it.  When I was 13 I bought a 1987 GT PFT from Chip and Dale BMX in Mt. Holly NJ.  I rode it for years and my mom ended up selling it when I went off to school in 1992.  I still haven't  forgiven her.  I planned on getting another one for years.  I was recently diagnosed with MS so I decided to build  the same bike and ride it while I still can.

I started looking for a bike to restore and found a 1988 GT Pro Performer and had it shipped from Long Island after paying for it with a postal money order. Â I really wanted a 1987. Â Even though I know the 88 is the same bike and I could restore it to look exactly like an 87, I wanted a true 1987 to restore. Â I found an 87 frame and fork on Craigslist that turns out was being sold by saenz21.

After talking over the phone we reached a deal to exchange my 88 frame and fork, stem, cranks, and sprocket plus $180 for his 1987 frame and fork, mallet stem, cranks and sprocket. Â Many may find this to be a bad deal to begin with, but I went ahead and bought it because the frame was sandblasted and ready for powder and the mallet stem and sprocket were already powdered. Â

Saenz21 stated that he did not want to use PayPal because they take too much money in fees (should have called off the deal right then, right?). He wanted a postal money order, so I packed up the bike and shipped it USPS with tracking number and insurance. Â I separately sent a money order for $210, an extra $30 to cover return shipping via USPS with a tracking number and insurance. Â Communication with saenz21 was stellar up to this point. Â I got tracking numbers on both the bike and the money order and confirmed saenz21 received both. Â He stated he would ship the 1987 back immediately. Â I waited a week, asking for a tracking number every day. Â He said he would get it to me but never did. Â That was about three weeks ago.

Saenz21 knows my number and never answers when I call. Â I have a friend with a phone number from another state and had him call and leave a message for Saenz21 stating that he was interested in one of his other bike parts. Â Saenz21 called him right back, at which time I got on the phone and demanded to know where my bike was. Â Saenz21 then states that he accidentally sent the 87 to a prominent member on this board but that person had not returned it, basically implying that it wasn't his fault. Â I demanded a tracking number to verify his story. Â He gave me a tracking number, which is confirmed to be invalid. Â I have called and texted him every day since with no reply. Â To add insult to injury, my 88 pro performer can be seen for sale on multiple sites.

I realize I made a stupid decision to send a postal money order instead of using PayPal. Â Believe me, the wife reminds me of this everyday that the bike doesn't show up. Â He stated that he did business with guys on this board and he has stuff for sale all over the Internet so I trusted him. Â

It looks like I am the latest to get ripped off. Â I personally liked the guy and trusted him right up to the time he took my bike and money and stopped responding to voicemails and texts. Looks like jac and mypk had similar experiences.

Can anyone confirm that they received a 1987 GT pro performer frame and fork with a mallet stem from saenz21? Â I personally think its BS but I thought it was interesting that he is blaming other members of this board for the reason why I don't have the bike.

I know I was foolish to trust this guy and I am embarrassed as hell for it, but if it keeps somebody else from getting ripped off it is worth it. Â If anyone wants to buy my 1988 GT, saenz21 currently has it for sale. Â Just do a google search for 1988 gt pro performer Hawaiian blue and it will pop up.Â

Since the USPS was used in the deal, I have talked with a postal inspector to see what can be done. Â As long as it can be shown that there was intent to defraud, it can be pursued. Â Looks like he's done it before, so I plan on pursuing this angle as I have everything documented and can show that he received the bike and cashed the money order.

In the event that saenz21 refuses to cooperate and complete the deal, I look forward to interacting with you guys, as I plan on recreating a 1987 GT PFT regardless. Â If saenz21 reads this call me. Â If anyone of you guys can verify that he accidentally sent a bike to you, please contact me.Â

My wife was diagnosed with MS 9 years ago, she changed her lifestyle and opted to stay away from the intense drugs she was told to take. She rides a bike everyday she can. You never know what the future holds, don't lose faith in the good things. I hope that deal eventually works out for you.

i am sad and mad about this and wish you luck on this matter with this person. i hope that he comes forward and sends everything owed to you, this also happened to me but i had paypal and they resolved it and from what im told was arrested on multiple charges of fraud. good luck with this person 79

thats wack. i HATE it when people dont respond when the news is not good, in any aspect of life....but man it takes sooo much less time and energy to just get it over with. and now youve got the "I told ya so" with the wife? he should be paying you interest on that one!! Good luck getting things straight. I had no idea this guy was banned, i recall him selling alot of stuff on this site.  i bought a set of odyssey brakes from him as gsanz, might have been the first purchase i made on this site.

He received the bike on November 6, 2012 and the money order on November 8, 2012.  Confirmed the money order was cashed on November 13, 2012.  I've got tracking numbers for the whole thing.  He works out of the San Antonio area.

Call the San Antonio police department and file a report if that is where his mailing address was located.  If the money order was a postal money order then he just committed the federal offense of mail fraud.  Also notify Craigslist and report him as a scammer.  Good luck bro.

OK  i thought that was odd, as a matter of fact, you, gsaenz, are one of the few who gave me a "glad you liked the parts" to my feedback after the sale.  And that is cool!

Yea gsaenz is pretty obviously not a scammer if he has 241 positive feedback. That really SUCKS, if this guy can be pegged for a federal offense of mail fraud he will go away for quite a while. I hope you get your 87 AND 88 both

Yes, that's my '88 frame and fork.  The '88 stem, cranks, and sprocket were also part of the deal.  The rest of the parts belong to saenz21.

The gyro is also mine, he said he would ship it back with the '87.  I was told the gyro was in the same box with the '87 that saenz21 sent to a member of this board.  It looks like it stayed on my '88 the whole time.  There's another inconsistency in the story I was told.

If you have a receipt from the MO hopefully a USPS one , you have protection.

The Postal Inspector will follow up and this Is a Federal Offense.  Let the USPS Inspector know all the info on him and address,

Sorry to hear about this situation yet saenz21 was placed on F/S restriction here months ago due to his selling practices and has not been an active member since.
